1. What we do, and what we are not
Situational Energy is an energy brokerage business serving commercial and industrial operators in deregulated U.S. markets. We review your utility account and work with a licensed commercial energy brokerage that prepares supplier pricing and executes contracts.
We are not a utility, not a retail energy supplier, and not a party to your supply contract. Your supply agreement is between you and the supplier you select. We do not guarantee that any supplier will offer you pricing, that any pricing will be lower than your current rate, or that your account is eligible for competitive supply at all. Many service territories, including those served by municipal utilities and electric cooperatives, are not open to supplier choice.
2. Performance figures on this site
Client counts, aggregate savings figures, and average reduction percentages shown on this website reflect the performance of our partner brokerage network across its client base, not the results of any single client and not results produced by Situational Energy alone. Energy pricing depends on your market, utility, load profile, consumption, creditworthiness, contract term, and prevailing wholesale conditions. Past results do not predict what you will be offered, and no savings of any amount are promised or guaranteed.
3. Information you give us
You confirm that you are authorized to act for the business whose account you submit, and that the information and documents you provide are accurate and yours to share. You authorize us to share them with our partner brokerage and with suppliers for the purpose of preparing pricing. How we handle that information is described in our Privacy Policy.
4. How we are paid
You do not pay us a fee. When a customer enters a supply contract sourced through our partner brokerage, that brokerage receives compensation from the supplier, and we receive a share of it. This means we have a financial interest in you entering a contract. You should evaluate any offer on its own merits.
5. No professional advice
Nothing on this site or in our communications is legal, tax, accounting, or financial advice. Energy procurement decisions carry commercial risk. Consult your own advisors.
6. Contact permission
When you submit a form, you agree we may contact you by phone, email, or text about your energy account, on the terms set out in the Privacy Policy. You can opt out at any time.
7. Intellectual property
The content, design, and marks on this site belong to Situational Energy. You may not copy or reuse them without written permission.
8. Disclaimer and limitation of liability
This site is provided “as is,” without warranties of any kind, express or implied. To the fullest extent permitted by law, Situational Energy is not liable for any indirect, incidental, consequential, or punitive damages, or for lost profits or lost savings, arising from your use of this site or from any supply contract you enter. Our total liability for any claim is limited to the compensation we actually received in connection with your account.
9. Changes
We may update these terms. The date at the top reflects the current version. Continued use of the site after a change means you accept it.
10. Governing law
These terms are governed by applicable U.S. federal law and the law of the state in which Situational Energy operates, without regard to conflict-of-law rules.
